Terms and Conditions

1. Introductory provisions of the Terms and Conditions

The Seller establishes the following terms and conditions applicable to purchases on the e-shop https:// www.riteintherain.cz.

The Terms and Conditions govern the rights and obligations of the parties when using the Seller's website located at https://www.riteintherain.cz to conclude a purchase contract (hereinafter referred to as the "Website") and other related legal relations. The Seller may change or supplement the wording of the Terms and Conditions. Subsequent amendments to the Terms and Conditions shall not affect the rights and obligations arising during the period of effectiveness of the previous version of the Terms and Conditions. 

2. Seller

The Seller means the operator of the e-shop at https://www.riteintherain.cz, which is Unique Ideas s.r.o., Příčná 129/3, 779 00 Olomouc, ID No.: 17082374, registered in the Commercial Register kept at the Regional Court in Ostrava, registered under file number C89171.

3. Order, purchase contract

The proposal to conclude a purchase contract is the placement of the offered goods by the seller on https:// www.riteintherain.cz. Unless otherwise stated below, the purchase contract is formed by the Buyer sending the order and the Seller accepting the order. The Seller shall promptly confirm such acceptance to the Buyer by informative e-mail.

4. Goods

Goods means the items offered for sale by the Seller via the e-shop on the website https://www.riteintherain.cz. The Seller undertakes that it will supply to its customers faultless goods in accordance with the specifications and characteristics set out in the details of the goods in question.

5. Price

The amount shown for each individual item is inclusive of VAT. The price of the goods is valid for the period for which it is published. However, this amount does not include delivery costs, which are shown separately. The final amount to be paid by the Buyer for the Goods, including delivery, is stated at the end of the order, and will be confirmed by the Seller by sending a confirmation of contract. The invoice issued based on the Buyer's binding order is a tax document.

6. Method of payment

The buyer is entitled to choose any of the following payment alternatives when purchasing goods:

(a) payment in cash or by credit card on delivery

(b) payment in advance by credit card or bank transfer

7. Delivery time and transport options

The delivery period starts from the date of acceptance of the order by the Seller. If the ordered goods are in stock, the Seller undertakes to ship and hand over the goods to the carrier within 2 working days. The delivery time is therefore 2 - 4 working days depending on the carrier's workload. The buyer is entitled to choose one of the following shipping alternatives when purchasing goods:

a) delivery to the chosen address by PPL transport service or Zásilkovna transport service

b) delivery to the dispensing point of Zásilkovna transport service

c) personal collection at the shop

Upon receipt of the goods from the carrier, the Buyer is obliged to check the integrity of the packaging of the goods and the goods themselves and in the event of any defects immediately notify the carrier. If the packaging is found to have been tampered with, the buyer shall not be obliged to take it over from the carrier but should not accept it. By signing the delivery note, the buyer confirms, that the consignment of goods has fulfilled all the conditions and requirements, that it has not been transported damaged. Any later complaint concerning damage to the packaging of the consignment cannot therefore be considered.

8. Withdrawal from the contract

The Buyer has the right to withdraw from the purchase contract within 14 working days of delivery of the goods without giving a reason. If the Buyer exercises the right to withdraw from the contract, he is obliged to notify the Seller of this fact during the contract in the form of a completed return slip and sending it to the email info@riteintherain.cz. The Buyer is obliged to return the undamaged and unworn goods and accessories to the Seller's address specified in point 2 of this document without undue delay, but no later than 14 days after the withdrawal from the purchase contract. If the Buyer withdraws from the contract, the Seller shall reimburse the Buyer, within 14 days of delivery of the returned goods, all funds, including delivery costs, received from the Buyer based on the contract to the account specified in the return note. The provision of the Act on withdrawal within 14 days cannot be understood as an option to lend the goods free of charge. The costs of returning the goods to the Seller shall be borne by the Buyer.

9. Claims

For goods ordered and purchased through https://www.riteintherain.cz, we provide a warranty of at least 24 months, starting from the date of delivery of the goods to the Buyer. In the event of a claim for defective goods, the Buyer shall send a completed claim form to info@riteintherain.cz. Upon receipt of the claim including the claim form, the Seller will contact the Buyer by e-mail or phone about how the claim will be handled within 2 working days. Shipping of the claimed goods in case of acceptance is paid by the Seller. Claims are also possible in the brick-and-mortar shop in Olomouc.

10. Out-of-court dispute resolution

If a consumer dispute arises between the Seller and the Buyer under the Purchase Contract which cannot be resolved by mutual agreement, the Buyer may file a motion for an out-of-court settlement of such dispute to the designated consumer dispute resolution body, which is:

11. Final provisions

These terms and conditions shall apply in the wording indicated on the Seller's website on the date of sending the electronic order, unless otherwise agreed in writing between the parties. By submitting an electronic order, the Buyer accepts without reservation all the provisions of the Terms and Conditions in the version valid on the date of the order submission, as well as the price of the ordered goods (including any shipping costs) valid on the date of the order submission.
